Eine beabsichtigte Änderung der europäischen Urheberrechtsgesetzgebung gefährdet derzeit den Bildbestand (nicht nur) von Citroën-Club-Foren sowie Club- und privater Homepages / Blogs bis hin zur Wikipedia in europäischen Ländern mit Panoramafreiheit.
Schon heute sind Einschränkungen existent, die den meisten so gar nicht geläufig sind, hier ein prominentes Beispiel:
Während das Hochladen von Bildern von und mit dem Eiffelturm bei tagsüber gemachten Aufnahmen auf Portalen wie Facebook (noch) kein Problem ist, sind die gleichen Aufnahmen bei Dämmerung oder Nacht nicht mehr zulässig (bzw. man muss entsprechende Gebühren befürchten), weil auf dem Eiffelturm eine Lichtinstallation montiert ist, die dem künstlerischen Urheberrechtschutz unterliegt.
Dies betrifft insbesondere die Veröffentlichung auf “kommerziellen” Portalen, und so, wie wir dies heute verstehen, sind dies nicht nur Facebook und Co., deren kommerzielle Nutzung in den AGB dokumentiert sind, sondern auch z.B. Homepages und Blogs, in denen kommerzielle Werbebanner eingeblendet sind, mit denen der Seitenbetreiber also Einnahmen generiert (wenn auch nur Cent-Beträge).

Freedom of Panorama: Massive Impact on Web Publications
A new EU proposal could see millions of European citizens, webpage owners and club homepage, forum and blog operators and owners face massive legal action for uploading photos of famous landmarks.
One famous example we recently got aware of – most likely not known to the vast majority of us:
While pictures taken during daytime of and with the Eiffel Tower, and then uploaded and published on sites like Facebook is (currently) no problem, the same shooting in twilight or at night resp. it’s upload onto the same portal might lead to unwanted consequences because at the Eiffel Tower a light installation is mounted which is subject to artistic copyright protection…!
This concerns in particular the publication on “commercial” portals, and as we understand it today, these are not just Facebook and similar whose commercial use are documented in their terms and conditions, but also, for example, on club homepages, forums and blogs where commercial banners are displayed, with which the site owner has embedded to potentially generate some revenue (albeit it might be just cents of revenue only).
